It may come as a big shock to you, the cell site landlord, but sometimes wireless tenants will overstep their lease authority. This can occur when your tenant adds new panel antennas; replaces small antennas with larger one; adds microwave dish antennas; adds new cabinets or replaces older cabinets with new and larger cabinets. Sometimes the over-occupancy occurs when the site is first installed, and the landlord doesn't catch the overage. When these things happen, It may be that under your lease you are due additional rent. Even if your lease doesn't expectedly call for additional lease revenue, it may be possible to increase your site rent for unauthorized site additions or modifications. We have recovered five- and six-figure rental fees and interest plus substantial future increases in rent for our clients experiencing over-occupancy. As a landlord, even if you're not concerned about the minor changes, you may find yourself on the wrong end of a permit violation compliance notice issued by your local government code inspector. Why? Because in some cases it is the underlying site owner that is responsible for the permit compliance of his or her wireless site tenants. We can tell you if the carrier has added unapproved facilities in violation of your lease, and we'll help you make it right. Give us a call today. Let's discuss your concerns during a no-charge initial consultation. Some of the answers might surprise you. |
